Probate (Certificate of Appointment of Estate Trustee)

If a person dies with a will, the the Executor bears these responsibilities. An application for “probate” (certificate of appointment of estate trustee with a will) is the process by which the validity of the will is established.  Once the will and appointment of executor(s) are approved by the court, the executor is able to distribute the assets in accordance with the deceased’s wishes.  If there is no will, the court appoints the executor by application for a certificate of appointment of estate trustee without a will, so that the assets may be distributed in accordance with the law.

The role of Executor is demanding.

The estate may involve extensive valuables or complicating factors, which may expand the scope of the Executor’s duties. The Executor is personally liable for administering the estate properly. Make sure you seek the legal counsel when taking on the responsibility of administering an estate.
